Passenger delay- Liability of the aircraft company

The court of appeal of Paris (14 March 2013) held that the aircraft company has committed a wilful misconduct (article 25-Warsaw convention) by denying the boarding of a passenger. Indeed the aircraft company was requested payment of additional taxes (due to extra weight) to the passenger before boarding. As per Warsaw convention (which applies as Burkina Faso (place of departure) does not ratify Montreal Convention) and article 1147 of the French civil code the carrier is condemned to pay damages to the passenger as the luggages were already registered and the passenger has also his boarding pass.
